Red face Highway code question

can anyone please advise me I have searched the highway code but cannot find anything relating to my "issue".
when travelling along a 3 lane dual carrageway, you are confronted by signs which indicate the middle and outside lanes are closed up ahead.
In plenty time you indicate to change lanes from the middle to the inside lane, but as you get closer to the "cones" or closed lanes, the drivers on the inside lane bunch up so you cant get in .
I vaguley remember a rule in the highway code which advises drivers on the inside to "give way" to drivers trying to enter the lane under roadwork conditions.
needless to say I have had a bump , I indicated to move in to a gap large enough for my car and the driver on the inside accelerated to stop me changing lanes and we collided .
any advice would help

If you had a witness to show the other driver was discouteous you should not have a problem as he would be clearly driving recklessly. You may not need a witness either in that I assume it was your back wing damaged and his front, therefore he should have been aware of your intentions and let you in.

Unfortunately it was my front his back wing, I was still on the rhs of the white line he accellerated in to the gap crossing the white line to prevent me maneouvering.

An indication that you wish to change lanes is a way of asking the other driver if you may pull in it, is not your right to pull in until it is either safe to do so or the other driver gives you permission.

hi ken
this help is too late for your case, but could be useful in future. although i don't recall any hard /fast rules regarding r/work behaviour in the h/code, the code does cover the matter in general terms & expects everyone to apply these terms to suit varying road & traffic conditions in the interests of public safety. ie when you first see lane closure signs, start your procedure to get in lane early & in my exp you won't have any probs, if on the other hand drivers wish to try & get in by or close to the cones TOO LATE & BLOODY SUICIDAL. there are plenty of warning signs so get in lane early. i am a very courteous driver & always hold back leaving space for motorists to get in lane upto the 250yd approach, usually by that distance traffic speed is down to less than 10 mph, after that i close any gap & any motorists attempting this ignorant, bad attitude move will quite rightly end up in the cones. i truly believe that motorists that do this type of driving, que jumping at r/ works should be severely prosecuted by the law, Heavily fined & licence endorsed with loads of penalty points. Finally ken i'm not saying that you fit this category of motorist, this is just my advice & view on this matter. regards djdave
